A <a class=\"external-link\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2020\/Mpv\/mpv958.htm\" target=\"_self\" title=\"\" rel=\"noopener noreferrer\">Medida Provis\u00f3ria 958\/2020<\/a> foi publicada no <em>Di\u00e1rio Oficial da Uni\u00e3o<\/em> desta segunda-feira (27). O texto determina que, at\u00e9 30 de setembro de 2020, os bancos p\u00fablicos ficam dispensados de cumprir certas obriga\u00e7\u00f5es na hora de renovar e conceder novos empr\u00e9stimos. <\/p>\n<div id=\"textoMateria\">\n<p style=\"text-align: left; \">Antes da medida provis\u00f3ria, por exemplo, sem a prova de que votou na \u00faltima elei\u00e7\u00e3o, pagou a respectiva multa ou de que se justificou devidamente, o eleitor n\u00e3o podia pedir empr\u00e9stimo \u00e0s institui\u00e7\u00f5es financeiras. Agora, tal exig\u00eancia est\u00e1 temporariamente suspensa. <\/p>\n<p style=\"text-align: left; \">Outra obrigatoriedade que fica suspensa at\u00e9 30 de setembro diz respeito ao Imposto Territorial Rural (ITR). At\u00e9 a edi\u00e7\u00e3o da medida provis\u00f3ria, a concess\u00e3o de incentivos fiscais e de cr\u00e9dito rural ficavam condicionadas \u00e0 comprova\u00e7\u00e3o do recolhimento do ITR correspondente aos cinco anos anteriores. Agora, isso n\u00e3o ser\u00e1 mais necess\u00e1rio. <\/p>\n<p style=\"text-align: left; \"><span>A MP 958\/2020 desobriga tamb\u00e9m os bancos de consultarem previamente o Cadastro Informativo de Cr\u00e9ditos n\u00e3o Quitados do Setor P\u00fablico Federal (Cadin) para realizar opera\u00e7\u00f5es de cr\u00e9dito que envolvam o uso de recursos p\u00fablicos; para concederem incentivos fiscais e financeiros e para celebrarem conv\u00eanios, acordos ou contratos que envolvam desembolso de recursos p\u00fablicos. <\/span><\/p>\n<p style=\"text-align: left; \">As institui\u00e7\u00f5es financeira tamb\u00e9m est\u00e3o autorizadas, tamb\u00e9m temporariamente, a realizar opera\u00e7\u00f5es de financiamento, com lastro em recursos p\u00fablicos, a pessoas jur\u00eddicas em d\u00e9bito com o Fundo de Garantia do Tempo de Servi\u00e7o (FGTS). <\/p>\n<p style=\"text-align: left; \">Da mesma forma, empresas n\u00e3o precisar\u00e3o apresentar a Certid\u00e3o Negativa de D\u00e9bito (CND) na contrata\u00e7\u00e3o de opera\u00e7\u00f5es de cr\u00e9dito, na contrata\u00e7\u00e3o com o poder p\u00fablico e no recebimento de benef\u00edcios ou incentivo fiscal ou credit\u00edcio concedido por ele. <\/p>\n<h3 style=\"text-align:left;\"><strong>Controle<\/strong><\/h3>\n<p style=\"text-align: left; \">Apesar de afrouxar exig\u00eancias legais para facilitar o cr\u00e9dito, a medida provis\u00f3ria n\u00e3o abriu m\u00e3o da fiscaliza\u00e7\u00e3o. As institui\u00e7\u00f5es financeiras ficam obrigadas a encaminhar trimestralmente \u00e0 Receita Federal e \u00e0 Procuradoria Geral da Fazenda Nacional (PGFN) a rela\u00e7\u00e3o de contrata\u00e7\u00f5es e renegocia\u00e7\u00f5es de d\u00edvidas que envolvam recursos p\u00fablicos, com a indica\u00e7\u00e3o dos benefici\u00e1rios, dos valores e dos prazos envolvidos.<\/p>\n<p style=\"text-align: left; \">A MP 958\/2019 ainda revoga o artigo 1.463 do <a class=\"external-link\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/LEIS\/2002\/L10406.htm#art1463\" target=\"_self\" title=\"\" rel=\"noopener noreferrer\">C\u00f3digo Civil<\/a> que, proibia o penhor de ve\u00edculos sem que estivessem previamente segurados contra furto, avaria e danos causados a terceiros. <\/p>\n<p style=\"text-align: left; \">O presidente da Rep\u00fablica pode publicar medidas provis\u00f3rias em caso de relev\u00e2ncia e urg\u00eancia. Elas t\u00eam for\u00e7a de lei desde a edi\u00e7\u00e3o. As MPs valem por at\u00e9 120 dias.
