{"id":35881,"date":"2024-05-15T17:44:08","date_gmt":"2024-05-15T20:44:08","guid":{"rendered":"https:\/\/maranhaotv.com.br\/?p=35881"},"modified":"2024-05-15T17:44:27","modified_gmt":"2024-05-15T20:44:27","slug":"tse-mantem-decisao-do-tre-ma-e-deixa-mary-do-mojo-fora-das-eleicoes-deste-ano-em-paco-do-lumiar","status":"publish","type":"post","link":"https:\/\/maranhaotv.com.br\/index.php\/2024\/05\/15\/tse-mantem-decisao-do-tre-ma-e-deixa-mary-do-mojo-fora-das-eleicoes-deste-ano-em-paco-do-lumiar\/","title":{"rendered":"TSE mant\u00e9m decis\u00e3o do TRE-MA e deixa Mary do Moj\u00f3 fora das elei\u00e7\u00f5es deste ano em Pa\u00e7o do Lumiar"},"content":{"rendered":"\n<p><br><br>Uma decis\u00e3o do ministro Andr\u00e9 Ramos Tavares, do Tribunal Superior Eleitoral, resultante do Recurso Especial (11549) N\u00ba 0602363-54.2022.6.10.0000 (PJe) acaba de deixar a vereadora do munic\u00edpio de Pa\u00e7o do Lumiar, Mary do Moj\u00f3, do PL, ineleg\u00edvel.\u00a0<br>A decis\u00e3o diz respeito a aus\u00eancia de presta\u00e7\u00e3o de contas de Mary nas elei\u00e7\u00f5es de 2022 quando ela disputou cargo de deputada federal e obteve 4.323 votos em todo o Maranh\u00e3o pelo partido do ex-presidente Jair Bolsonaro.<br>O Tribunal Regional Eleitoral do Maranh\u00e3o (TRE-MA) jugou como \u201cn\u00e3o prestadas\u201d as contas de Moj\u00f3, o que como consequ\u00eancia, deixa a vereadora ineleg\u00edvel para as elei\u00e7\u00f5es municipais deste ano.<br>\u201cA presta\u00e7\u00e3o de contas final de campanha deve ser apresentada em dois momentos: transmitida pela internet e entregue atrav\u00e9s de m\u00eddia eletr\u00f4nica nos Tribunais ou nos Cart\u00f3rios Eleitorais, com os documentos referidos pelo art. 53, II, da Resolu\u00e7\u00e3o TSE n\u00ba 23.607\/2019. A candidata n\u00e3o apresentou m\u00eddia eletr\u00f4nica contendo os documentos\u00a0essenciais dentro do prazo legal, mesmo tendo sido regularmente intimada, devendo ser as contas julgadas como n\u00e3o prestadas (art, 74, IV, \u201cb\u201d, da Res. TSE n\u00ba 23.607\/2019). Contas julgadas n\u00e3o prestadas, devendo a candidata ficar impedida de obter certid\u00e3o de quita\u00e7\u00e3o eleitoral at\u00e9 o final da legislatura \u00e0 qual concorreu, persistindo os efeitos da restri\u00e7\u00e3o ap\u00f3s esse per\u00edodo at\u00e9 a efetiva regulariza\u00e7\u00e3o das contas (art. 80, I e \u00a71\u00ba, da Resolu\u00e7\u00e3o em comento).\u201d Diz a decis\u00e3o.<br>Em sua decis\u00e3o, o ministro Andr\u00e9 Ramos Tavares diz que na origem, o TRE\/MA julgou n\u00e3o prestadas as contas da candidata recorrente haja vista que, embora ela tenha enviado as contas finais via internet, em 26.10.2022, n\u00e3o apresentou a m\u00eddia eletr\u00f4nica no prazo legal, mesmo depois de devidamente intimada a faz\u00ea-lo.<br>O TSE diz que apesar da devida intima\u00e7\u00e3o, via mural, uma vez que representada por advogado regularmente habilitado aos autos, a prestadora [Mary do Moj\u00f3] n\u00e3o apresentou a m\u00eddia das contas finais dentro do prazo estabelecido pela legisla\u00e7\u00e3o eleitoral (prazo final em 19\/11\/2022, uma vez que intimada em 16\/11\/2022), tendo apresentado a m\u00eddia eletr\u00f4nica apenas em 13\/02\/2023.<br>\u201cNo caso dos autos, contudo, o Tribunal de origem reiterou no ac\u00f3rd\u00e3o integrativo (ID n\u00ba 160041558) que a m\u00eddia eletr\u00f4nica configura documento essencial para o exame das contas, por se tratar de elemento finalizador, representativo da imutabilidade de conte\u00fado apresentado, o que impede a incid\u00eancia dos postulados. Dessa forma, alterar a conclus\u00e3o que consta no ac\u00f3rd\u00e3o de origem, nesta seara especial, mostra-se invi\u00e1vel diante da veda\u00e7\u00e3o disposta na S\u00famula n\u00ba 24\/TSE, al\u00e9m de o recurso incidir no \u00f3bice das S\u00famulas n\u00ba 72, n\u00ba 28 e n\u00ba 30\/TSE, elementos que imp\u00f5em a inviabilidade de seguimento da insurg\u00eancia. Ante o exposto, nego seguimento ao recurso especial, com base no art. 36, \u00a7 6\u00ba, do Regimento Interno do Tribunal Superior Eleitoral.\u201d decide o
