O desembargador Kleber Carvalho, do Tribunal de Justi\u00e7a do Maranh\u00e3o (TJMA), indeferiu, nesta quinta-feira (4), um recurso interposto pela prefeita de Pa\u00e7o do Lumiar, Paula da Pindoba (PCdoB), e manteve o seu mais recente afastamento, por 90 dias.

A gestora insurgiu-se contra decis\u00e3o tomada na semana passada pelo juiz Gilmar Everton Vale, titular do Termo Judici\u00e1rio da 1\u00aa Vara de Pa\u00e7o do Lumiar.

A comunista est\u00e1 fora do cargo desde o dia 29 de maio, quando j\u00e1 havia sido alvo de uma decis\u00e3o da desembargadora Maria da Gra\u00e7a Amorim, tamb\u00e9m do TJMA, tirando-a do posto por 50 dias \u2013 essa decis\u00e3o foi derrubada liminarmente pelo desembargador Vicente de Castro.

No agravo de instrumento rejeitado, Pindoba alegou, dentre outras coisas, \u201cque a determina\u00e7\u00e3o de seu afastamento cautelar do exerc\u00edcio do cargo de prefeita afigura-se desproporcional, pois contrasta com a realidade f\u00e1tico-jur\u00eddico do objeto em investiga\u00e7\u00e3o, bem como com os princ\u00edpios jur\u00eddico-constitucionais do Estado Democr\u00e1tico de Direito, notadamente a presun\u00e7\u00e3o de inoc\u00eancia\u201d.

Em seu despacho, Kleber Carvalho destacou que a den\u00fancia que motivou novo afastamento da prefeita cont\u00e9m \u201cind\u00edcios suficientes da veracidade dos fatos\u201d. Nesse caso, Paula Pindoba \u00e9 acusada, junto com a ex-secret\u00e1ria municipal de administra\u00e7\u00e3o e finan\u00e7as, Fl\u00e1via Nolasco; a ex-secret\u00e1ria municipal de sa\u00fade, Danielle Oliveira; a ex-secret\u00e1ria municipal de desenvolvimento social, Elizabeth Diniz; e a secret\u00e1ria municipal de planejamento e articula\u00e7\u00e3o governamental do munic\u00edpio, Luana Peixoto, de firmar contratos supostamente irregulares com a empresa R C Prazeres e Cia. Ltda. para loca\u00e7\u00e3o de ve\u00edculos.

Uma das provas de ilegalidade \u00e9 que no contrato firmado entre a Prefeitura e a empresa, consta que houve o fornecimento de 62 carros, por\u00e9m, segundo o Detran-MA, a empresa possui apenas sete ve\u00edculos registrados.

\u201cSe promoveu a juntada de documenta\u00e7\u00e3o dando conta de que a Procuradoria Geral do Munic\u00edpio expediu of\u00edcio ao Departamento Estadual de Tr\u00e2nsito solicitando informa\u00e7\u00f5es sobre a empresa vencedora do certame e obteve como resposta que a empresa possui apenas 07 (sete) ve\u00edculos registrados em seu nome, os quais, ademais, consistem em modelos de ve\u00edculos incompat\u00edveis com o objeto licitado e contratado, de modo que, ao menos num ju\u00edzo de cogni\u00e7\u00e3o n\u00e3o-exauriente, n\u00e3o h\u00e1 que se falar em propositura temer\u00e1ria da vertente a\u00e7\u00e3o de improbidade administrativa\u201d, destacou o magistrado em sua decis\u00e3o.
Para ele, \u201cn\u00e3o se afigura desarrazoado ou desproporcional o afastamento do cargo pelo prazo de 90 (noventa) dias \u2013 o qual, por previs\u00e3o legal, pode ser inclusive prorrogado uma \u00fanica vez por igual prazo, mediante decis\u00e3o motivada (LIA, art. 20, \u00a7 2o) \u2013, pois seria o tempo m\u00ednimo necess\u00e1rio para, repise-se, aprofundar a apura\u00e7\u00e3o acerca da materialidade dos atos de improbidade administrativa alegados e evitar a concretiza\u00e7\u00e3o do risco de utiliza\u00e7\u00e3o, repito, da \u2018condi\u00e7\u00e3o de chefe do poder executivo para forjar ou omitir documentos p\u00fablicos com o fim de obstruir as investiga\u00e7\u00f5es que pesam contra a gestora\u2019, tal como externado no decisum a quo\u201c.

\u201cAssentadas essas premissas, n\u00e3o vislumbro o preenchimento do requisito da probabilidade de provimento do recurso (\u201cfumus boni juris\u201d), tampouco do requisito do \u201cpericulum in mora\u201d porquanto a agravante n\u00e3o demonstrou, de modo preciso e cabal, a grave les\u00e3o a direito, \u201csendo insuficiente a mera alega\u00e7\u00e3o de que o afastamento cautelar do cargo de prefeito teria o cond\u00e3o de provocar preju\u00edzos ao Poder P\u00fablico. Precedente do STJ.\u201d, completou.

Prorroga\u00e7\u00e3o \u2013 Como revelou o Imirante na quarta-feira (3), cabe tamb\u00e9m ao desembargador Kleber Carvalho o julgamento de um outro pedido referente ao caso. Nesta semana, a gest\u00e3o do\u00a0prefeito interino, Inaldo Pereira (PSDB), protocolou uma peti\u00e7\u00e3o solicitando a extens\u00e3o, por mais 120 dias, do afastamento da titular do cargo.
Como n\u00e3o h\u00e1 pedido liminar nesse novo processo, o caso deve ser levado a plen\u00e1rio. Se for deferido o pedido, Paula Azevedo n\u00e3o retorna mais ao cargo, uma vez que o atual mandato se encerra no dia 31 de dezembro, a menos de seis meses, portanto.<\/p>\n\n\n\n
