{"id":36823,"date":"2024-07-18T07:15:03","date_gmt":"2024-07-18T10:15:03","guid":{"rendered":"https:\/\/maranhaotv.com.br\/?p=36823"},"modified":"2024-07-18T07:15:03","modified_gmt":"2024-07-18T10:15:03","slug":"tce-suspende-contrato-de-r-10-milhoes-da-prefeitura-de-sao-luis-com-sobrepreco-de-quase-r-4-milhoes","status":"publish","type":"post","link":"https:\/\/maranhaotv.com.br\/index.php\/2024\/07\/18\/tce-suspende-contrato-de-r-10-milhoes-da-prefeitura-de-sao-luis-com-sobrepreco-de-quase-r-4-milhoes\/","title":{"rendered":"TCE suspende contrato de R$ 10 milh\u00f5es da prefeitura de S\u00e3o Lu\u00eds com sobrepre\u00e7o de quase R$ 4 milh\u00f5es"},"content":{"rendered":"\n<p><br>O Tribunal de Contas do Estado do Maranh\u00e3o (TCE-MA) decidiu aceitar a Medida Cautelar sobre uma representa\u00e7\u00e3o apresentada pela empresa\u00a0Lavebras Gest\u00e3o de Texteis S.A\u00a0contra a\u00a0Central Permanente de Licita\u00e7\u00e3o do Munic\u00edpio de S\u00e3o Lu\u00eds\u00a0relativa a irregularidades no procedimento licitat\u00f3rio Preg\u00e3o Eletr\u00f4nico\u00a0n\u00ba 233\/2023.<br><br>A representa\u00e7\u00e3o alega que a empresa foi desclassificada do certame licitat\u00f3rio por n\u00e3o ter apresentado, tempestivamente, o Certificado de Regularidade da Empresa e do Respons\u00e1vel T\u00e9cnico no Conselho Profissional competente. No entanto, a empresa alega que juntou todos os documentos exigidos no Edital antes da abertura da sess\u00e3o e que sua desclassifica\u00e7\u00e3o foi ilegal e arbitr\u00e1ria.<br><br>O Conselheiro\u00a0\u00c1lvaro C\u00e9sar de Fran\u00e7a Ferreira, relator do processo, destacou que a desclassifica\u00e7\u00e3o da Lavebras se logrou do excesso de formalismo exigido e pela consequente rejei\u00e7\u00e3o do certificado de comprova\u00e7\u00e3o de regularidade da empresa, apesar de ser apenas um documento complementar e erro san\u00e1vel.<br><br>O Conselheiro tamb\u00e9m destacou que a probabilidade do direito \u00e9 observada pelos fatos narrados e pelos documentos acostados nos autos, decorrendo da flagrante ofensa \u00e0 ordem constitucional. O perigo de dano \u00e9 evidente diante dos riscos de grave preju\u00edzo aos cofres p\u00fablicos, uma vez que h\u00e1 evidente sobrepre\u00e7o na proposta da empresa vencedora do certame.<br><br>O Preg\u00e3o Eletr\u00f4nico n\u00ba 233\/2023, teve como objetivo o Registro de Pre\u00e7os em ATA para\u00a0eventual contrata\u00e7\u00e3o de empresa especializada na presta\u00e7\u00e3o de processamento de roupas hospitalares, compreendendo entre outros, a coleta, lavagem, desinfec\u00e7\u00e3o, secagem e distribui\u00e7\u00e3o, com fornecimento de enxoval em comodato e fornecimento de material, m\u00e3o-de-obra e equipamentos, para atender as necessidades das Unidades de Sa\u00fade ligadas a Superintend\u00eancia de Assist\u00eancia a Rede de Sa\u00fade, visando \u00e0 obten\u00e7\u00e3o de adequadas condi\u00e7\u00f5es de salubridade e higiene, com execu\u00e7\u00e3o indireta, conforme especifica\u00e7\u00f5es e quantitativos estabelecidos no Termo de Refer\u00eancia, com valor estimado da contrata\u00e7\u00e3o, segundo o Edital, \u00e9 de\u00a0R$ 12.032.736,00 (doze milh\u00f5es, trinta e dois mil, setecentos e trinta e seis reais).<br><br>A\u00a0Lavebras Gest\u00e3o de Texteis S.A\u00a0foi declarada vencedora do Preg\u00e3o Eletr\u00f4nico 233\/20023, em todos os lotes, com a proposta global de R$ 6.753.748,30 (seis milh\u00f5es, setecentos e cinquenta e tr\u00eas mil, setecentos e quarenta e oito reais e trinta centavos) e posteriormente foi desclassificada.<br><br>Em raz\u00e3o de sua desclassifica\u00e7\u00e3o da\u00a0Lavebras\u00a0foi convocada a empresa remanescente,\u00a0LEN\u00c7\u00d3IS MARANHENSES LAVANDERIA INDUSTRIAL E HOSPITALAR LTDA,\u00a0cuja proposta foi de\u00a0R$ 10.730.029.10 (dez milh\u00f5es, setecentos e trinta mil, vinte e nove reais e dez centavos). Com isso houve um flagrante sobrepre\u00e7o da proposta da empresa Len\u00e7ois Maranhenses em rela\u00e7\u00e3o \u00e0 sua anteriormente classificada, cujo valor \u00e9 superior em\u00a0R$ 3.976.280.80\u00a0(tr\u00eas milh\u00f5es, novecentos e setenta e seis mil, duzentos e oitenta reais e oitenta centavos).<br><br>O TCE n\u00e3o encontrou informa\u00e7\u00f5es do contrato no SINC-CONTRATA, o que \u00e9 mais um agravante do caso pois vai contra a determina\u00e7\u00e3o prevista no artigo 4\u00ba da Instru\u00e7\u00e3o Normativa n\u00ba073\/2022, com isso pode pagar multa de\u00a0R$ 1.000,00 (mil reais).<br><br>Dessa forma, o conselheiro deferiu a Medida Cautelar at\u00e9 o julgamento de m\u00e9rito, para suspender os efeitos de todos os seus atos, inclusive eventuais pagamentos referentes ao contrato que tenha sido assinado, oriundos do referido certame com a empresa Len\u00e7\u00f3is Maranhense Lavanderia Industrial e
