Mais uma vez o Solidariedade buscou o Supremo Tribunal Federal (STF) para impedir a escolha de um novo conselheiro do Tribunal de Contas do Estado do Maranh\u00e3o (TCE-MA). O partido alega inconstitucionalidade pela vota\u00e7\u00e3o ser secreta na Assembleia Legislativa, para validar a escolha do governador Carlos Brand\u00e3o.
No entanto, se a decis\u00e3o for jur\u00eddica e n\u00e3o pol\u00edtica, a ADI do Solidariedade n\u00e3o deve prosperar, at\u00e9 porque j\u00e1 existe jurisprud\u00eancia no STF sobre o assunto.
Em decis\u00e3o recente, no dia 13 de dezembro de 2024, o STF decidiu, por unanimidade, que os indicados para o cargo de conselheiro do Tribunal de Contas do Estado de Sergipe (TCE-SE) podem ser aprovados pelo Legislativo por voto secreto, como prev\u00ea a Constitui\u00e7\u00e3o estadual. A decis\u00e3o foi tomada no julgamento da A\u00e7\u00e3o Direta de Inconstitucionalidade (ADI) 4964.
Em seu voto, o relator da a\u00e7\u00e3o, ministro Nunes Marques, afastou a alega\u00e7\u00e3o de inconstitucionalidade do voto secreto. Ele observou que o sigilo na vota\u00e7\u00e3o para escolher o conselheiro do TCE indicado pelo Legislativo segue a mesma l\u00f3gica da vota\u00e7\u00e3o do Senado para aprovar o nome indicado pelo presidente da Rep\u00fablica para o Tribunal de Contas da Uni\u00e3o (TCU).<\/p>\n","protected":false},"excerpt":{"rendered":"
