Por\u00e9m, conforme cita a peti\u00e7\u00e3o, este crit\u00e9rio est\u00e1 previsto no Regimento Interno da Assembleia desde 1991, sendo apenas realocado topograficamente ao longo dos anos, sem qualquer altera\u00e7\u00e3o de conte\u00fado.<br><br>A premissa de Moraes \u00e9 totalmente equivocada e foi exatamente isso que a Procuradoria-Geral da Assembleia Legislativa peticionou. A ALEMA informou que o crit\u00e9rio j\u00e1 existe no Regimento Interno h\u00e1 34 anos. \u201cTodas as edi\u00e7\u00f5es do Regimento Interno, desde 1991, previram o crit\u00e9rio de desempate de maior idade\u201d, diz trecho da peti\u00e7\u00e3o assinada pelo procurador-geral Bivar Batista.<br><br>\u201cO atual inciso IV do art. 8\u00ba do Regimento Interno (reda\u00e7\u00e3o dada pela Resolu\u00e7\u00e3o Legislativa n\u00ba 1.300, de 5 de novembro de 2024) \u00e9 reprodu\u00e7\u00e3o de normas anteriores \u2013 vigentes h\u00e1 34 anos -, quais sejam: art. 8\u00ba, IX, do Regimento Interno de 1991; art. 8\u00ba, IX, do Regimento Interno de 2001; art. 8\u00b0, VI, do Regimento Interno de 2004; art. 8\u00b0, VI, do Regimento Interno de 2011; e art. 8\u00b0, VI, do Regimento Interno de 2021\u201d, detalha o procurador no documento, para atestar a veracidade do que afirma e p\u00f4r prevenir qualquer interpreta\u00e7\u00e3o errada que possa vir a surgir.<br><br>A peti\u00e7\u00e3o destaca, ainda, que tanto a Advocacia-Geral da Uni\u00e3o (AGU) quanto a Procuradoria-Geral da Rep\u00fablica (PGR) reconheceram essa continuidade normativa, afastando a tese de
