A gest\u00e3o do prefeito Rafael Brito, em Timon\/MA, contratou uma empresa rec\u00e9m-criada para executar um contrato milion\u00e1rio de reforma em 11 escolas da rede municipal. A APRIMORE Incorpora\u00e7\u00e3o & Engenharia LTDA foi selecionada por meio de uma dispensa de licita\u00e7\u00e3o sob a justificativa de emerg\u00eancia, mas a escolha levantou s\u00e9rias suspeitas ap\u00f3s a fiscaliza\u00e7\u00e3o do Tribunal de Contas do Maranh\u00e3o (TCE-MA) e do Minist\u00e9rio P\u00fablico.
Segundo os documentos, a empresa vencedora firmou contrato com a prefeitura em 19 de fevereiro de 2025, apenas 43 dias ap\u00f3s sua abertura, registrada no Cadastro Nacional da Pessoa Jur\u00eddica em 7 de janeiro do mesmo ano. Apesar do contrato de R$ 12,7 milh\u00f5es exigir experi\u00eancia comprovada na execu\u00e7\u00e3o de reformas e obras p\u00fablicas, n\u00e3o foi apresentada nenhuma documenta\u00e7\u00e3o que atestasse a capacidade t\u00e9cnica ou experi\u00eancia anterior da empresa nesse tipo de servi\u00e7o.
Outro ponto alarmante apontado pelo relat\u00f3rio t\u00e9cnico do TCE \u00e9 que a APRIMORE n\u00e3o possu\u00eda registro no Conselho Regional de Engenharia e Agronomia do Maranh\u00e3o (CREA-MA) no momento da assinatura do contrato. O registro s\u00f3 foi efetivado em 4 de abril de 2025, ou seja, semanas ap\u00f3s a formaliza\u00e7\u00e3o da contrata\u00e7\u00e3o e in\u00edcio das obras, em descumprimento \u00e0s exig\u00eancias legais.
A situa\u00e7\u00e3o da empresa tamb\u00e9m chamou aten\u00e7\u00e3o durante dilig\u00eancia realizada pelo Minist\u00e9rio P\u00fablico do Maranh\u00e3o. No endere\u00e7o cadastrado como sede da APRIMORE, um galp\u00e3o no bairro S\u00e3o Benedito, os t\u00e9cnicos n\u00e3o encontraram qualquer sinal de funcionamento. O im\u00f3vel estava fechado, n\u00e3o havia placa de identifica\u00e7\u00e3o e nenhum funcion\u00e1rio foi localizado, o que levantou d\u00favidas sobre a estrutura real da contratada para assumir uma empreitada desse porte.
Al\u00e9m disso, o valor contratado extrapola o limite legal de faturamento anual para empresas enquadradas como EPP (Empresa de Pequeno Porte), o que pode configurar infra\u00e7\u00e3o \u00e0 Lei Complementar n\u00ba 123\/2006. Somado a isso, o contrato foi assinado com recursos do FUNDEB, o que exige ainda mais rigor e transpar\u00eancia na execu\u00e7\u00e3o.
A aus\u00eancia de documentos b\u00e1sicos, como projeto t\u00e9cnico, cronograma f\u00edsico-financeiro, comprovantes de pesquisa de pre\u00e7os e justificativa detalhada de escolha do fornecedor, agrava as suspeitas de favorecimento indevido e uso indevido da dispensa de licita\u00e7\u00e3o.
Diante dos fatos, os auditores do TCE pediram a imediata suspens\u00e3o dos pagamentos e apura\u00e7\u00e3o rigorosa da contrata\u00e7\u00e3o, que se mostra incompat\u00edvel com os princ\u00edpios da legalidade, economicidade e efici\u00eancia na gest\u00e3o dos recursos p\u00fablicos. A atua\u00e7\u00e3o do Minist\u00e9rio P\u00fablico tamb\u00e9m segue em curso, podendo desdobrar-se em medidas judiciais e a\u00e7\u00f5es de responsabiliza\u00e7\u00e3o contra os envolvidos.
