O Tribunal Superior Eleitoral decidiu por unanimidade, nesta quinta-feira (23), que as mudan\u00e7as previstas na chamada \u201cLei Antifac\u00e7\u00e3o\u201d n\u00e3o ter\u00e3o validade nas elei\u00e7\u00f5es gerais de 2026. A norma, sancionada pelo presidente Lula em mar\u00e7o deste ano, previa a proibi\u00e7\u00e3o do voto para presos provis\u00f3rios, mas foi considerada inaplic\u00e1vel ao pr\u00f3ximo pleito por violar o princ\u00edpio da anualidade eleitoral, previsto na Constitui\u00e7\u00e3o Federal.
A decis\u00e3o foi tomada em julgamento administrativo da Corte Eleitoral, ap\u00f3s voto do relator Antonio Carlos Ferreira e acompanhamento do ministro Andr\u00e9 Mendon\u00e7a, que havia pedido vista do processo.
