A Justi\u00e7a em Minas Gerais acatou nesta sexta-feira, 14, a den\u00fancia do Minist\u00e9rio P\u00fablico do Estado contra 11 executivos da Vale, inclusive o ex-presidente da mineradora, F\u00e1bio Schvartsman, e cinco funcion\u00e1rios da empresa de consultoria T\u00fcv S\u00fcd por homic\u00eddio doloso duplamente qualificado e crimes ambientais causados pelo rompimento da barragem da companhia em Brumadinho em 25 de janeiro do ano passado, que levou \u00e0 morte de 270 pessoas \u2013 11 das quais ainda n\u00e3o foram encontradas.<\/p>\n

A den\u00fancia foi apresentada pelo MP em 21 de janeiro e tamb\u00e9m responsabilizou a Vale e a T\u00fcv S\u00fcd pelos crimes. Schvartsman era presidente da mineradora \u00e0 \u00e9poca da ruptura da estrutura.<\/p>\n

Com a aceita\u00e7\u00e3o da den\u00fancia, todos os denunciados das duas empresas viram r\u00e9us. Na den\u00fancia, o MP diz que \u201cficou demonstrada a exist\u00eancia de uma prom\u00edscua rela\u00e7\u00e3o entre as duas corpora\u00e7\u00f5es denunciadas, no sentido de esconder do poder p\u00fablico, sociedade, acionistas e investidores a inaceit\u00e1vel situa\u00e7\u00e3o de seguran\u00e7a de v\u00e1rias barragens de minera\u00e7\u00e3o mantidas pela Vale\u201d.<\/p>\n

A promotoria apontou ainda que ficou configurado o homic\u00eddio duplamente qualificado pelo fato de os crimes terem sido \u201cpraticados atrav\u00e9s de meio que resultou perigo comum, j\u00e1 que um n\u00famero indeterminado de pessoas foi exposto ao risco de ser atingido pelo violento fluxo de lama\u201d. Al\u00e9m disso, \u201cconcluiu-se que os crimes foram praticados mediante recurso que impossibilitou ou dificultou a defesa das v\u00edtimas\u201d.<\/p>\n

Especificamente em rela\u00e7\u00e3o ao ex-presidente da Vale, o promotor William Garcia, respons\u00e1vel pela investiga\u00e7\u00e3o criminal do MP, disse, na apresenta\u00e7\u00e3o da den\u00fancia \u00e0 Justi\u00e7a, ter volume \u201csubstancial\u201d de provas de que Schvartsman sabia do problema da estrutura e n\u00e3o tomou medidas necess\u00e1rias. Segundo ele, o ex-presidente \u201cmanteve incentivos corporativos para maquiar problemas corporativos\u201d da Vale e \u201catuou diretamente para criar a falsa impress\u00e3o de plena seguran\u00e7a das barragens\u201d.<\/p>\n

Schvartsman, conforme as investiga\u00e7\u00f5es, recebeu e-mails informando problemas na barragem. Foi apreendida uma mensagem an\u00f4nima de 9 de janeiro de 2019 \u2013 16 dias antes do desastre. Isso fez com que o ent\u00e3o presidente deixasse claro internamente que problemas com estruturas n\u00e3o deveriam chegar \u00e0 c\u00fapula da Vale. O denunciante usou e-mail criptografado, com servidor na Alemanha. Garcia disse que o ex-chefe da Vale concentrou esfor\u00e7os para localizar o autor, que seria funcion\u00e1rio da Vale.<\/p>\n
